Terms and conditions of use

1. Object

These general conditions of sale govern all relations between our Company:

• (hereinafter referred to as “LA SITTELLE”);

And ,

The Internet customer (hereinafter referred to as the “CUSTOMER”) who makes a purchase on the “vinegar-balsamique.com” site accessible at the address: https://www.vinaigre-balsamique.com (hereinafter referred to as the “Site”).

Sales and orders placed on the Site with the Company La Sittelles are exclusively governed by these general conditions of sale to the exclusion of any other document or correspondence emanating from the CUSTOMER.

Placing an order with the La Sittelle Company necessarily implies, as an essential and determining condition, the full and unreserved acceptance by the CUSTOMER of these general conditions of sale.

2. Price

The prices of our products are indicated in euros, all taxes included (VAT and other taxes applicable on the day of the order), unless otherwise indicated and excluding processing and shipping costs. 

In the event of an order to a country other than mainland France, you are the importer of the product(s) concerned. Customs duties or other local taxes or import duties or state taxes may be payable. These rights and sums do not fall within the jurisdiction of the La Sitelle Company.

They will be your responsibility and are your entire responsibility, both in terms of declarations and payments to the competent authorities and organizations in your country. We advise you to inquire about these aspects with your local authorities. 

All orders whatever their origins are payable in euros.  

The company La Sittellese reserves the right to modify its prices at any time, but the product will be invoiced on the basis of the price in force at the time of validation of the order and subject to availability. 

The products remain the property of the company La Sittelle until full payment of the price.

Please note : as soon as you take physical possession of the products ordered, the risk of loss or damage to the products is transferred to you.

3. Orders

The contractual information is presented in French and will be confirmed at the latest when your order is validated.  

The company La Sittelle reserves the right not to record a payment, and not to confirm an order for any reason whatsoever, and more particularly in the event of a supply problem, or in the event of difficulty concerning the order received.

4. Validation of your order

Any order appearing on the website www.vinaigre-balsamique.com assumes adherence to these General Conditions. Any order confirmation implies your full and complete acceptance of these general conditions of sale, without exception or reservation.  

All the data provided and the recorded confirmation will constitute proof of the transaction. 

You declare that you have perfect knowledge of it.  

The order confirmation will constitute signature and acceptance of the operations carried out.  

A summary of the information in your order and these General Conditions will be communicated to you via  the email address confirming your order.

5. Payment

The fact of validating your order implies for you the obligation to pay the price indicated.  

You can pay by credit card or check.

Payment by credit card : the transaction and payment are secure.

We inform you that your payment card is debited when you validate your payment with the secure payment center which sends you a payment confirmation email.

6. Withdrawal

In accordance with the provisions of article L.121-21 of the Consumer Code, you have a withdrawal period of 14 days from receipt of your products to exercise your right of withdrawal without having to justify reasons or to pay penalty.  

Directive 2011/83/EU authorizes you to do something similar to that which you might be authorized to do in store to evaluate the product and thus assert or not your right of withdrawal. Returns must be made in their original condition and complete (packaging, accessories, instructions). In this context, your

liability is engaged. Any damage suffered by the product on this occasion may be such as to frustrate the right of withdrawal. 

Return costs are free: they will be refunded to you on simple request, by transfer to your bank card as part of a payment by credit card or by transfer as part of a payment by check (in this case, remember attach a RIB to your request).

In the event of exercising the right of withdrawal, the company La Sittelle will reimburse the sums paid, within 14 days following notification of your request and  via  the same means of payment as that used when ordering. 

Exceptions to the right of withdrawal

In accordance with the provisions of article L.121-21-8 of the Consumer Code, the right of withdrawal does not apply to:  

• The provision of services fully executed before the end of the withdrawal period and whose execution has started after the express prior agreement of the consumer and express waiver of his right of withdrawal.

• The supply of goods or services whose price depends on fluctuations on the financial market beyond the control of the professional and likely to occur during the withdrawal period.

• The supply of goods made to the consumer's specifications or clearly personalized.

• The supply of goods likely to deteriorate or expire quickly.

• The supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection.

• The supply of goods which, after being delivered and by their nature, are inseparably mixed with other items;

• The supply of alcoholic beverages whose delivery is deferred beyond thirty days and whose value agreed at the conclusion of the contract depends on fluctuations on the market beyond the control of the professional.

• The supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery.

• The supply of a newspaper, periodical or magazine, except for subscription contracts for these publications.

• Transactions concluded at a public auction.

• The supply of digital content not provided on a material medium whose execution has begun after the express prior agreement of the consumer and express waiver of their right of withdrawal.

7. Availability

Our products are offered as long as they are visible on the site www.vinaigre-balsamique.com and while stocks last.

If a product is unavailable after placing your order, we will inform you by email. Your order will be automatically canceled and no bank debit will be made.

In addition, the website www.vinaigre-balsamique.com is not intended to sell its products in large quantities. Consequently, the company La Sittellese reserves the right to refuse orders for more than 100 identical items.

8. Deliveries

Orders are delivered to the delivery address indicated during the purchase process, within the time indicated on the order validation page.

If a shipping delay occurs, an email will be sent to you to warn you of a possible impact on the delivery time indicated to you. 

In accordance with legal provisions, in the event of late delivery, you benefit from the possibility of canceling the order under the conditions and terms defined in article L 138-2 of the Code of

Consumption. If in the meantime the order is received we will reimburse it as well as the delivery costs under the conditions of article L 138-3 of the Consumer Code.

In the event of deliveries by a carrier, the company La Sittellene may be held responsible for the delay in delivery due exclusively to the unavailability of the customer after several appointment proposals.

Delivery by La Poste Colissimo:

When the order is placed on the internet you will receive an automatic email announcing the dispatch of your order.

• In mainland France and Monaco, the package is delivered to the requested address and in case of absence, it is left at the nearest post office.

• For packages in zone 1 and 2, transport is carried out according to La Poste's agreements with their service providers in the country. The package is delivered against signature.

9. Shipping Methods, Shipping Costs and Shipping Areas

Mainland France, Corsica and Monaco

In mainland France, Corsica and Monaco, delivery costs are calculated as follows:

• Order over €100: free shipping

• If the amount is greater than €50 and less than €100 the shipping costs are €13.75

• If the amount of your basket is greater than €100: Shipping costs are FREE

Colissimo delivery date:

For mainland France Monaco, the company La Sittelles undertakes to deliver within 7 days from confirmation of payment. For deliveries to countries in zones 1 and 2, the deadline by which La Sittelles undertakes to deliver is one month from payment confirmation.

Delivery issues:

The buyer must check the condition of the packaging and the conformity of the products delivered upon delivery. Any complaint for non-conformity of the delivered products must be notified by the buyer, by registered letter with acknowledgment of receipt, within 72 hours of receipt both to the carrier whose address appears on the delivery note and to Customer Service. from the company La Sitelle. An email may also be sent to us at the following address: contact@vinaigre-balsamique.com.

Any complaint about apparent defects in the products delivered must be notified by the buyer within 8 days of receipt by sending a registered letter with acknowledgment of receipt to the Customer Service of the company La Sittelle or an email to the following address: contact @vinaigre-balsamique.com.

It will be up to the buyer to provide La Sittelle with any necessary justification for their claim.

In the event that the complaint is accepted, the buyer will be able to benefit from the reimbursement or exchange conditions provided.

In the absence of a complaint made within the aforementioned deadlines, the products will be deemed to conform and accepted by the buyer.

10. Warranty

All our products benefit from the legal guarantee of conformity and the guarantee against hidden defects, provided for by articles 1641 et seq. of the Civil Code. In the event of non-conformity of a product sold, it may be returned, exchanged or refunded.

All complaints, requests for exchange or refund must be made by email within 30 days of delivery. 

The products must be returned to us in the condition in which you received them with all the elements (accessories, packaging, instructions, etc.). Shipping costs will be reimbursed to you on the basis of the price invoiced and return costs will be reimbursed upon presentation of supporting documents by transfer to your bank card as part of a payment by bank card or by transfer as part of payment by check (in this case, remember to attach a RIB to your request).

The provisions of this Article do not prevent you from benefiting from the right of withdrawal provided.

11. Liability

The products offered comply with current French legislation. The company La Sittellene cannot be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities the possibilities of importing or using the products or services you plan to order.

Furthermore, the company La Sittellene cannot be held responsible for damage resulting from improper use of the product purchased.

Finally, the company La Sittellene cannot be held responsible for any inconveniences or damages inherent in the use of the Internet network, in particular a break in service, an external intrusion or the presence of computer viruses.

In case of damage:

Please note your reservations on the carrier's documents or refuse delivery, and notify us by mail. This procedure is mandatory so that the item ordered is exchanged or refunded, as well as the return costs as quickly as possible. We insure the goods to the place of delivery but cannot nevertheless be held responsible for an impossibility of delivery beyond our control (absence, error in wording in the address, etc.), so ensure accuracy delivery addresses. Any inaccuracy may result in a significant delay and additional cost which will be passed on to you. Any delay due to force majeure (strikes, bad weather, etc.) will not engage the responsibility of the company La Sitelle.

12. Applicable law in the event of a dispute

The sales contract is governed by French law, any disputes relating to the interpretation or non-performance of said contract will be within the jurisdiction of the jurisdiction of the place where the defendant resides, of the jurisdiction of the place of actual delivery of the item or the place of performance of the service.

13. Intellectual property

All elements of the site www.vinaigre-balsamique.com are and remain the intellectual and exclusive property of the company La Sitelle. No one is authorized to reproduce, exploit, redistribute, or use for any reason whatsoever, even partially, elements of the site, whether software, visual or sound. Any simple or hypertext link is strictly prohibited without the express written consent of the company La Sitelle.

14. Personal data

The company La Sittellese reserves the right to collect nominative information and personal data concerning you. They are necessary to manage your order, as well as to improve the services and information we send to you. More generally, your data can allow us to:

15. Archiving & Proof

The company La Sittelle will archive purchase orders and invoices on a reliable and durable medium constituting a faithful copy in accordance with the provisions of article 1348 of the Civil Code. 

The computerized records of the company La Sittelle will be considered by all parties concerned as proof of communications, orders, payments and transactions between the parties.
